In 2021, partner Carja Mastenbroek of Good Law represented Puma in proceedings against Monshoe Fashion. Last 2 March 2022, District Court of The Hague rendered judgment, in favour of Puma.
Court in The Hague has ruled that Puma’s form strip marks are part of ‘a well-known family of marks’. The sign affixed by Monshoe to the side of the shoes Shoecolate and Pearlz is very similar to Puma’s form strip marks.
Carja Mastenbroek: ‘Monshoe thereby took undue advantage of, or detracted from, the distinctive character or reputation of the form comic brands without due cause.
Monshoe must cease any infringement of Puma’s form strip marks and is ordered to give up and issue a recall.
