A win for the famous formstrip of Puma

In November 2021 Carja Mastenbroek represented Puma in proceedings against Monshoe Fashion. Last 2 March 2022, the District Court of The Hague ruled in favour of Puma!

The Court ruled that the formstrip trademarks of Puma are part of a well-known family of trademarks. The sign that Monshoe has applied to the side of its shoes Shoecolate and Pearlz is very similar to the formstrip marks of Puma. Monshoe thereby takes unfair advantage of, or is detrimental to, the distinctive character or reputation of the formstrip marks without good reason.

Monshoe must cease and desist any infringement of the form strip marks of Puma and is ordered to make a statement and a recall.

NRC published an article about this in its newspaper of 16 March 2022. Read the ruling here.
