Identity fraud
In 2019, Good Law assisted a private individual whose personal data were wrongly included in the BKR (the Dutch office for credit registration). An identity fraudster ordered products from various webshops in the name of the private individual and left the invoices unpaid. After the private individual refused to pay the invoices, her details were included in the BKR. Despite the fact that the webshop as well as the collection agency to which the claim had been transferred had been informed of the fact that the data in the BKR were incorrect (supported by an official report stating identity fraud), they refused to remove the data. The case was ultimately submitted to the Dutch Court. It ruled that the debt collection agency had acted unlawfully by refusing to remove the BKR registration after the private individual had requested this. The collection agency was ordered to compensate part of the damage claimed by the private individual.
