From seduction to deception: consumer protection online

The Dutch Authority for Consumers & Markets (“ACM”) has set the boundaries where seduction turns into deception online in the Online Consumer Protection Guide. The Guidelines form the basis for enforcement by the ACM. The Guidelines make it clear to businesses when online deception is involved. It is important that the following principles are taken into account when making online offers:

- Provide complete information;

- Provide correct information;

- Provide understandable information;

- Provide the information before the consumer buys something;

- Make sure the information is easy to find;

- Provide logical and honest design;

- Provide favorable default settings for consumers;

- Take into account the vulnerability of consumers; and

- Test the effects of your online decision environment.
