Portrait rights

The use of a portrait without the consent of the person depicted or the heirs of the person depicted is subject to a balancing of interests. In doing so, it must be ascertained whether a reasonable interest of the person portrayed opposes its disclosure. Aspects that play a role in the balancing of interests are the nature and intimacy in which the person portrayed is depicted, the character of the photograph and the context of the publication.
