Trade names

If the trade names of two companies are very similar, but the companies are far apart and mainly operate locally, the risk of direct confusion (explanation) may be limited. However, the use of virtually the same trade name and the same nature of the companies may lead to a real risk of indirect confusion. In this case it is important that in practice there is actual confusion. In those circumstances, there is an infringement of trade name rights. Find the judgement here (only available in Dutch).
